Important Legal Notice

Please read these Terms of Service carefully. By using this website or our services, you agree to these terms. These terms include important limitations on our liability and your legal rights. If you do not agree, do not use this website or our services.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Elizabeth Rosario Law ("we," "us," "our," or "the Firm") governing your use of our website located at elizabethrosariolaw.com ("Website") and any related services provided by the Firm.

By accessing, browsing, or using this Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease using the Website and our services.

Applicable Law: These Terms are governed by the laws of the State of Michigan and North Carolina (where our offices are located) and federal law, without regard to conflict of law principles. Users accessing from other states or countries (including Mexico) agree to be bound by these terms.

2. No Attorney-Client Relationship

2.1 Website Use Does Not Create Representation

IMPORTANT: Use of this Website, including viewing content, submitting contact forms, sending emails, or participating in evaluations, DOES NOT create an attorney-client relationship. No attorney-client relationship exists until:

  • We have conducted a conflicts check and confirmed we can represent you
  • We have provided you with a written engagement agreement
  • You have signed and returned the engagement agreement to us
  • Any required retainer or initial payment has been received
  • We have sent you written confirmation that we are representing you

2.2 No Duty to Act

Until an attorney-client relationship is formally established in writing, we have no duty to act on your behalf, monitor deadlines, or take any action regarding your immigration matter. Time-sensitive immigration matters may expire while you are communicating with us. You are solely responsible for monitoring and complying with all immigration deadlines.

2.3 Right to Decline Representation

We reserve the absolute right to decline representation for any reason, including but not limited to: conflicts of interest, case complexity, lack of resources, ethical concerns, or business considerations. Participation in a case evaluation does not obligate us to accept your case.

3. Information and Legal Advice Disclaimers

3.1 No Legal Advice

The information on this Website is for general informational purposes only and does NOT constitute legal advice. No content on this Website (including blog posts, articles, FAQs, case studies, or any other materials) should be construed as legal advice or as creating an attorney-client relationship.

3.2 Constantly Changing Immigration Law

Immigration law is complex and changes frequently through new statutes, regulations, executive orders, court decisions, and agency policy changes. The information on this Website:

  • May not reflect the most current legal developments or changes
  • May not apply to your specific circumstances
  • Is not a substitute for an evaluation with a qualified immigration attorney
  • May become outdated without notice

3.3 No Guarantees or Predictions

We make no guarantees, promises, or predictions about the outcome of any immigration case or application. Every case is unique and depends on individual circumstances, evidence, applicable law, and government discretion. Past results do not guarantee future outcomes.

3.4 Case Studies and Testimonials

Case studies and client testimonials on this Website represent specific factual situations and outcomes. They do not guarantee similar results in other cases. Immigration results depend on many factors including individual circumstances, current law, and government adjudication practices.

3.5 Recipe Content Disclaimer

Our "Cocinando con la Abogada" recipe section is provided for informational and cultural purposes only. We make no warranties regarding food safety, allergen information, or dietary suitability. Users assume all risks associated with preparing and consuming recipes.

4. Case Evaluation Terms

4.1 Free Case Evaluations

We offer free initial case evaluations to assess potential representation. These evaluations:

  • Are for preliminary assessment purposes only
  • Do not create an attorney-client relationship
  • Do not constitute legal advice
  • Do not guarantee case acceptance or specific outcomes
  • May be limited in time and scope at our discretion
  • Do not obligate us to provide further services

4.2 Emergency Contact Submissions

While we strive to respond promptly to emergency contact forms and deportation defense inquiries, submission of an emergency form does not guarantee immediate response or representation. We are not responsible for any harm, deportation, or adverse consequences that occur while you are attempting to contact us or awaiting our response.

4.3 Conflicts of Interest

We must decline representation if a conflicts check reveals we cannot ethically represent you. Information disclosed during evaluations may prevent us from representing adverse parties in the future, even if we decline your case.

5. Scope of Services and Jurisdiction

5.1 Immigration Law Only

We practice exclusively in U.S. immigration and nationality law. We do not provide advice regarding: criminal law, family law, business law, tax law, or any other legal areas. References to other legal matters on this Website are for informational purposes only.

5.2 Geographic Limitations

Our attorneys are licensed to practice law in Michigan and North Carolina. We handle federal immigration matters nationwide. For matters requiring state bar admission, we associate with local counsel or appear pro hac vice as permitted. We do not provide legal advice regarding foreign country laws (including Mexican law) except as it relates to U.S. immigration proceedings.

5.3 Citizenship Test Preparation

Our citizenship test practice tools are provided as study aids only. We do not guarantee that:

  • Questions match those on the actual USCIS test
  • Practice test results predict actual test performance
  • Using our tools will result in passing the citizenship test
  • Information is complete, accurate, or up-to-date with current USCIS requirements

6. Fees, Payments, and Refunds

6.1 Fee Agreements

All fees for legal services must be agreed upon in writing in a signed engagement agreement. No fee information on this Website constitutes a fee quote or agreement. Actual fees depend on case complexity, time required, and other factors.

6.2 Government Fees

USCIS, Department of State, and other government filing fees are separate from our legal fees. Government fees change frequently and are non-refundable. We are not responsible for government fee increases or changes in filing requirements.

6.3 Refund Policy

Refund policies are specified in individual engagement agreements. Generally, earned fees for work performed and costs already incurred are not refundable. Government filing fees paid to USCIS or other agencies are never refundable.

6.4 Payment Processing

We use third-party payment processors. We are not responsible for payment processing errors, delays, or security issues related to third-party processors. Users accessing from Mexico or other countries are responsible for any currency conversion fees or international transaction charges.
